TOPIC 1

What is ACT114A?

On 18 April, Nazri Aziz tabled a second amendment to the Evidence Act 1950 in Dewan Rakyat. James Dawos Mamit supported the motion, and the Evidence (Amendment) (No2) Act 2012 was passed after the second and third reading. On 9 May, Dewan Negara passed the amendment.

114A is the newly added section to the Evidence Act 1950. The amendment has wide-ranging reach and extends to practically everyone who uses any Internet platform–from e-mail and social media, to blogs and online media.

How would ACT114A affect you?

Base on this Act if your account has been hacked, or used in any other unknown reason in the situation you do not know or can not explain the speaker's identity, you will take the responsibility for any of the online post witch is  considered seditious or defamatory by the government, you are guilty until proven innocent.

Does it really matter?

Yes it does.It allows hackers and cyber criminals to be free by making the person whose account/computer is hacked liable for any content/data which might have changed.

Should you be concerned?

Yes we should be concerned. This act is not scientific.

  2. It wasn't scientific, and it almost impossible to prove your innocence if this thing does happen. I mean, for example, how are you suppose to prove that a certain X person, at certain time and certain place, is at your home, in your room, touching your keyboard, logging in using your Facebook account, and spreading false fact on the net?

Even worse if that person already know your personal online information/login information, he/she could easily log into your account and sabotage you anytime and anywhere.
