Section 114A is a new amendment to the Evidence Act 1950 in Malaysia.
This law will impact anyone who uses the Internet, computers, or mobile devices thatwhich means just about everyone, from individual users to businesses.
Due to the law has only recently been gazetted, we don,t know exactly how it will be applied, but below of article will explain what can affect you and me as a result of Section 114A.
The Section 114A really matter within communication.
For example, Chong set up a private Wifi network in his house. Any device within 500m of his home can detect Chong's Wifi. The network is password-protected, but the password is not very strong.
And Ahmad's computer is within the range of Chong's Wifi network. After a few attempts,
Chong successfully connects to Ahmad's network and "leeches" Ahmad"s Wifi without
his knowledge or consent.
While he is connected to Ahmad's network, Chong sends an email to all his contacts that accuses his boss of wrongdoing.
Chong uses a false name in his e-mail address to conceal his identity.
After receiving the email, Chong's boss seeks to sue the sender for defamation.
The authorities trace the email back to Ahmad's private Wifi network.
According to Section 114A, Ahmad is deemed the publisher and could be sued for a defamatory email he did not send.
Though above of article, we know we all will become guilty if we doing wrong something in others' Wifi network. Moreover, the Section 114A will cause a lot of unnecessary trouble.
I think everyone, especially Malaysian must be concern this issue, because it will become evolution until to an atmosphere of even have words, but not dare to says!

I like u post. because that is why i don't like this act114a, it cause a lot of trouble and a lot innosent people like ahmad because of chong use his wifi to accuses chong's boss of wrongdoing by using a false name.Then, ahmad been deemed the publisher under act114a. In the way ahmad become the victim
ReplyDeleteI like the example.If the lows focus on the criminals, then they should know who is the criminal really are. The criminal is not the devices, or the accounts, because these things is usable to any humanbeing. the act114a is a good for the lazy cops and hackers. but bad for the normal people.
ReplyDeleteThe existence of this Act could lead to a lot of serious problem, I can't help but think how easy it is to sabotage someone by manipulating this act, and from what I see in Malaysia, a lot of people doesn't put much care about their own safety online.
